From my experience The people at the national center have no idea whats happening when compared to the guys at the specific centers. The national centers issues generic solutions. (Say fill a form and wait for 45 days. If after 45 days there is no answer they again send the form, etc) If you really want to know more or get proper action, the people at the specific centers will have to be contacted.
The old way to get to the specified center is back. Dont listen the messages, just press the order of the buttons and it will work.

Hi All,
Sorry for posting this in an Immigration forum. I am just trying to get some advise from people who might have already been in this situation.
My cousin came to US on F-1 visa in Jan 2007. She has been attending grad school in NY...She got money from India to pay for her tuition for the first semester as she had no financial aid....One professor promised her aid starting Aug 2007 but that prof left the university for personal reasons so I paid her tuition/insurance for one semester ($10k)....I have also been helping her with her living expenses since she arrived in US....She only worked 1 day throughout the year and has a W-2 with $29 as earnings for 2007...
My question is, can I claim her as a dependent in my tax filing....She lives in NY and I work/live in TX.....I am planning to consult a tax professional regarding this, but I just wanted to get a heads up from you all before visiting a professional.

Question 1] Will this new H1B for Company B be valid for 3 more years (Till Feb 2011) or will this visa have to be renewed in November 2008 (remember by visa stamp for Company A is valid till Nov 2008)?
Generally you should get 3 years, if you have three years to get to the 6 year limit of H1B.
Question 2] What if I want to travel to India this October (remember by visa stamp for Company A is valid till Nov 2008)?? Can I still travel on my old visa stamp or will I need to go to embassy again in India for a new stamp
A Colleague of mine did this and did not have an issue. He went to india last Oct with his previous visa stamped in his passoort and I 797 approval of the new visa. My Company lawyers told him that he wont have any issues and he is back from his vacation and working. So i guess he did not have any issues.
What I dont know if how long was his previous visa valid for but I dont think it should matter till it is valid for sometime when you try to enter the country.

Today, I received an email from USCIS that my EAD application got approved. My receipt date is on the 3rd week of May of 2007. What I don't understand is that the current processing time at NSC for I-765(EAD) for pending I-485 is March 26th, 2007.....

I REALLY like the water lily shot, Josh. The composition is beautiful, with the other lily pads forming a "circle of circles" counterbalance to the flower. Very, very nice ... in fact, probably my favorite of all your posted photos. (not that I have anything against the others)

The United States Citizenship and Immigration Service (USCIS) has recently issued a fact sheet (http://www.aila.org/content/fileviewer.aspx?docid=30372&linkid=210853) reminding qualifying applilcants to apply EARLY for an Advance Parole document, as Advance Parole processing times take about 90 days.
The list of applicants who must obtain an Advance Parole document before traveling outside of the United States is as follows:
� Applicants that have been granted Temporary Protected Status (TPS);
� Applicants with a pending application for adjustment of status to lawful permanent resident (LPR);
� Applicants with a pending application for relief under section 203 of the Nicaraguan Adjustment and Central American Relief Act (NACARA 203);
� Applicants with a pending asylum application; or
� Applicants with a pending application for legalization
If you are an Appllicant with a pending Application for Adjustment of Status to Lawful Permanent Resident (LPR) and need assistance with filing Form I-131 (http://www.uscis.gov/USCIS/New%20Structure/2nd%20Level%20(Left%20Nav%20Parents)/Forms%20-%202nd%20Level/Forms%20Static%20Files/I-131.pdf), contact our office, as we currently have a SPECIAL running for the preparation and filing of the Advance Parole (http://www.h1bvisalawyerblog.com/2009/10/special_ead_and_advance_parole.html) document.

Following is the situation:
My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).
Falling short of 10 weeks to get the 365 days rule
Options that I learnt for me getting 7th yr extension and staying in the country:
Option1:
Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Convert from H4 to H1 and start working.
Option 2:
Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Stamping in canada to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 3:
Go back to India for 3 months wait till June 20th,
File for 7th year extension based on the 365 days rule
Stamping in India to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 4:
Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

In my employer company (NJ based, desi consulting company) about 50% of the EB-2 PERM applications are under audit.
I need to file my application for EB-2 and I called them. (I have a EB-3 approved labor, on which my employer has filed I-140)
The paralegal advised me that they have stopped filing PERM applications since this month March 2008, hoping that there would be change of PERM processing or application change.
Does any one have any info about PERM change process? Please advise. Thanks in advance.
The DOL was supposed to issue new forms, since the current ones were said to expire in 3/2008. However, they have not issued new forms yet, and on their website it states that the current ones continue to be valid. Their site was down for maintenance around the end of March, however, so perhaps that's what the paralegal was referring to?

It's really unfortunate, but what's in that cartoon is the truth. The humor is for people who don't have to go through that flow-chart or the people who get out quick.
