i send in my i-140/i485 along with those for my wife. as luck will have it, I forgot to include her sealed i-693. i am planning to send it tomorrow with a cover letter. is that okay? is there anything else I can do?

I need some advice in connection with a letter I received from USCIS for an in-person interview. It says that this interview will be video taped. It mentions a list of items to bring to the interview if they are checked, but none of the items in this letter are checked.
The items are:
- This letter, passport, I-94
- Medical exam results, Form I-693
- A current letter of employment
- Evidence of a common residence and shared life
- Other
My priority date is not current. And, my I-140 is approved and it has been more than 6 months since I-485 filing. I changed jobs about 4 months ago and did not transfer my H1B and started working using EAD. My H1B was revoked by my last employer. Also, I did not send a AC21 letter after switching jobs.
Is not sending the AC21 letter the reason for this interview? Also, since none of the items in the letter is checked, what does this mean? Please advise.

Hi,
The last time I came back into this country, I used my AP as I didn't have my H1 stamped. My H1 is valid till 2010.
My EAD expired last month and my bumbling lawyer did not send in the I-485 copy and hence there was an RFE. So I still do not have an EAD approval.
Would it be safe to get paid this month or should I have my company process this month's salary after I get my EAD approved?

this is what i think... i am no expert.
wait until you get ur SSN before you file.
you would have to file 2009 as F1 (so 1040NR) NR meaning non resident.
2010 onwards you file as a resident (for tax purposes) so that means you file regular 1040.
Have you ever filed a tax return before? If so do you havean ITIN (in lieu of SSN)?

I am currently working with green card sponsored employer on H1B (I have my EAD). I have my I485 pending with I140 approved and its been more than 180 days since my I485 has been pending. I am looking to use AC21, but concerned with the following agreement. Is this enforceable? Its been couple of years since I signed this and I know it's still a long wait before my I485 is approved. I saw in some forums that the O�Net Code was revised down grading the Specific Vocational Preparation level of most IT jobs to greater than 2 years and up to and including 4 years.
In this way, I read that the key to apply under EB2 is only being �Research� : research into fundamental computer and information science.

Hi,
I am a US citizen and my mom has been coming to the US once every 3-4 years for the last 15 years on a visitor visa (around 5-6 times). Each time, we had no issue in extending her stay, but her extension got denied yesterday. While I could have applied for her GC, she really did not prefer to apply for a GC since she wanted to spend more time in India than here.
My questions are as follows:
1. I have not got the official letter yet (had email notification), but is there really anything we can do to appeal her extension denial. I think I pretty much sent everything I could possibly can - letter with reasons similar to earlier extensions, return ticket itinerary, affidavit of support, bank statements etc. Another reason we gave is that she cannot travel alone - and my brother is leaving to India in 2 months and she wants to go back with him. I dont know what else we can say to extend her stay.
2. My mom is around 75 years old, and we really don't want to explore the option of leaving within 10 days (she never visited my brother in the last 5 years and she is with him now for only the last 2 weeks after a cross-country flight and recuperating). What I would like to know is - how soon can she safely leave. I think my mom is pretty much done with the US - and doesnt care if she gets a 3 year ban. But - I would like to know if there is any issue if she leaves in 2-3 months (i.e. overstay by 2 months considering the date she got her denial). Will they know at the US airport where she leaves, that she overstayed and (possibly) detain her for questioning. I know there are some airports that require you to document that you left by using a thumb-print.
3. 6 months+ overstay = 3 year ban. < 6 months overstay = ? (is this at the discretion of the POE officer? Can he deny entry - which would be kind of the worst possible future situation, but would like to know so that we can take as much of an informed decision as possible.
4. Can I apply for her GC now to keep her stay legal? Again, even if I apply - she is GOING back to India in 2 months and I will likely need to withdraw her application later.
Any advice on her options is appreciated.

Employer is legally bound to pay for you fare. Get a quote from any airline agent and present the same to your employer for the fare. They are bound to cut you check for the amount or whatever is the cheapest fare (if they can find one for you). If this does not happen then report the employer to USCIS/DOL immediately so that you get a time bound response if you have plans to leave the country.

� It does not matter if he is PhD or not, what matters is that the job for which his company will be applying his Labor justifies a Masters or PhD. If he qualifies, then yes, go ahead and file a new labor.
� New labor is not as fast to get approved as was earlier. It is taking from anywhere 12-14 months now a days to get it approved. It is only after labor approval that you can port.

Last year, When I filed I-485/EAD/AP, I wrote the check in favor of DHS (abbreviated) and it was accepted.
