Switch from Adjustment of Status (AOS) to Consular Processing. The caveat is you lose your EAD and will have to wait for your PD to be current before you can work in the US again. Unless you get a new H1 and want to start over!

Thanks...I haven't worked with cap H1b before.
So it seems IMPOSSIBLE to change job from university to company since most companies won't help you apply H1B on April and wait 6 months (till Oct) to put you into work.

Shustermann says that today ist the last day that all the employment- based-preference categories are current (exception unskilled workers). Ok, now he sasy : We recommand that Employers and their attorneys e-filing their I-140 today.
Please explain me if thats so important to file today the I-140 becouse just today the priority date are current.
I dont understand whats has the filing form I-140 to do with the priority Dates. Priority date is the PERM date??

yes, the I-140 is also for NIW cases, but remember that your priority date is not "fixed" unless you have an approved I-140 backing up that petition.
What Shusterman is saying is that file the I-140 today and get receipt notice (number) and then based on the priority dates being current only till today you will be able to file the I-485 before Aug 17th.

You cannot travel and enter US with expired AP. Please renew your AP. Stamp on AP cannot make any difference as per my knowledge. You will have your I-94 also with same time stamp.

Serious immigration legislation is in the air. Rep Shuler's (D-
NC) enforcement-only bill has attracted a fair number of supporters, and the rumor is that the House Republicans will try to force through a discharge petition necessitating a vote on the bill. While we are skeptical that a discharge petition has much chance of success, the House Democratic leadership is apparently not so sanguine (for info on discharge petitions, see here).

The House Hispanic Caucus has prepared a plan to meet the antis head on if they force a vote on the Shuler Bill.
The plan begins with the proposition that any serious discussion of immigration on the Hill will definitely harm Republican presidential nominee McCain. If he supports the "pros", the anti immigration fanatics in the Republican party will not support him in the general election; if he supports the "antis", it will weaken his appeal to the independents for the general election.
Second, should a vote on the Shuler bill come about, the House Hispanic caucus would seek to attach numerous benefit amendments to it - there is every likelihood that some of these amendments will succeed, a raising of the H cap, for example. Hopefully, so the thinking among the strategists among the House Democrats goes, the success of a few amendments will be a "poison-pill"
guaranteeing the defeat of the over-all measure since the antis are not in a mood to make any deal trading enforcement with benefits at this time. Ironically, the antis in the House may be forced to vote against the amended Shuler bill, thus positioning the Democrats as the real pro-enforcement party.
Our take is that once started down the Hill (pun intended), the momentum of an immigration bill would be hard to stop, and we might end up with something along the lines of the Kennedy-Kyl compromise of last spring, but without the point system which doomed it. To the surprise of many, Comprehensive Immigration Reform appears far from dead. And once again, it's the antis who deserve the credit for bringing benefits to the fore.

Given the situation for 485 denial. AFAIK, You have an option of filing for H1B (not counted against quota) based on your B's labor approval and pending 140. Once you use the EAD, technically you don't have the H1B status to transfer or extend. Hence, it will require you to go to consulate (b/c approval will come without I94) to stamp, and start working for Company B after you return.

My applications reached NSC 6 months ago on July 9th.
I have no receipts and checks were not cashed.
As per IO's my name is not in the system.

The first status is that USCIS has approved your EAD and ordered for a card. The second status means that they mailed you the card. You should get the card in next 5 business days.

Not to be too ignorant, but it sounds like you can use any strobes as long as the triggering mech. works with your camera. I would prefer wireless. I guess I wasn't aware that the E-TTL wouldn't factor in either. Boy, I have a lot to learn. Thanks guys.
