I enter US four times this year by using AP, same airport, but different experience. 1st, 2nd and 3rd entry was sent to secondary check. But the 4th entry, the CBP said it's unnecessary for secondary check and fill new I-94 because previous officers are new guys, don't know the rule. I thought 1st entry is definitely need go secondary check.

Hi,
My wife came to US on H4 and changed to F1 status thru COS. She is doing Masters 2nd semester and went for F1 visa stamping this week in India. She got 221(g) pink slip asking explain her projects, plans afer study etc. Visa officier withheld her passport and I20.
BTW the way I am on H1B and provided all the financial support documents.
I searched the online didnt any F1 getting 221(g) pink.
1)If anyone else got this for F1 please share your experiences and any tips.
2)How long it takes after repsonding to thier queries
3)what are the chances getting visa after getting 221(g) pink
4) Do you suggest getting any professional in drafting the reponse to te queries.. if so do you know any one in Hyderabad, India

Submit what the IO requested. With F1, the usual problem is proving no intent for immigration.

As per VB:
The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date earlier than the cut-off date may be allotted a number.
They stress and bolded "Earlier Than" so i am not IN???? :confused::confused::(:(

my wife has filed for her I-485 (AOS) with me.
She has an H1 whch expires in 2012.
she used her AP while entering US this year at port of entry. Office gave I-94 for one year(it expires in Jan 2011).
Now my question is does she has to do anything to renew her I-94?
If she doesnt renew her H-1 now will she be still in-status on H1?
does she have to renew her AP in order to stay in status?
This area of the law is very confusing and it would be great if some attorney or expert give their valuable suggestions on this.

AP is only for travel purpose. She will be either on AOS or H1 Status.
If she wants to work, she needs to get either EAD or keep the H1 status. Since she used the AP upon return, she is now not in H1B status. Check with attorney if you want to restore to H1

after you recieve the EAD card you have to apply for SSN at your local SSN office.the time period to recieve SSN is different in different states.i guess the minimum time is 15 business days. please correct me if I am wrong.

I married to a US citizen and got conditional permanent residency which is subject to be removed after 2 years. I have been a student at a university, and while an application for permanent residency I had to show/combine my income (student teaching/research assistantship) in I-864 because my spouse's income was not sufficient to sponsor me. In form I-864 instructions it says, "Intending immigrant is your spouse, his/her income can be used to combine with your income if his/her income will continue from the same source after receiving lawful permanent residency." Now, my question is that I have an offer of admission from other school, and this new school will pay me student teaching/research assistantship, can I leave my current school and join the new one? If not, how long I have to wait in order to have right to change my school?
Secondly, can my spouse leave her job and sit idle? I ask this because my spouse sponsored me in I-864, and I wonder until when she is supposed to continue her current job!
Please advise me your best to help me with my doubts. I will be obliged!

How much time did the attorney ask for on the I-129 and LCA? If either is just one year, then there's no basis for appeal. CIS did nothing wrong.

Yes. First I-140 should be cleared for you to port your PD to the second I-140.

This is simple posturing and nothing more. Hispanic caucus CANNOT bring down healtcare reform. They have as much invested in the healthcare bill as anybody else in the Congress. They way I see it, this equates to a sucide threat if my friend won't shot at the enemy. All this to make a show to the hispanic population that hispanic caucus is doing something to push for the immigration bill. Nothing more. I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?
What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?
I am confused, its a good offer, and i dont know what to do. pls help..
An H1 transfer is not really a transfer. Just that you'll get another employer who is willing to and who can legally hire you. It does not mean you HAVE TO work for the new employer.
All the options you discussed here are safe for you.
1) Get H1 'transferred' now and join the new employer after 6 months are over
2) Get H1 'transferred' now and don't join the new employer.
Just make sure your new job description is similar to your LC job description and it has been 180 days since you filed your I-485.. Chill

I have same case, and I used my own sponsorship that got 10 years visa for my parents.
For the counselor, visiting a son is a more important need than visiting a brother.
