I'm facing a frustrating issue and am hoping that someone can provide help on this. I'm on my H1 10th year extn. My I-140 (EB-3) was recently approved and I cannot apply for I-485 as the visa dates are not available. My Company recently changed their name from ABC, doing business as XYZ, to DEF, doing business as XYZ (the doing business as part of the name is the same and there was no merger, just a name change).
My first question is does this invalidate my approved I-140 and should I refile the I-140. Also, when I file my H-1 extension what document should I provide to prove the name change (or is it even needed?)? Any help on these 2 questions would be greatly appreciated. Thanks.

I want to go for a H1B stamping in Canada. I am a PR of Canada.
I have been working with this employer since sep-06. I was on vacation from 13-Jan-07 to 13-Feb-07 in this period i was not paid as i was on personal leave. After coming from vacation I got a project on 05-Mar-07. So I did'nt have any pay stubs between 13-Jan-07 and 04-Mar-07. I was on project till 25-May-07. I was looking for a project for a while and i got a new offer from an employer in canada so i moved to canada on 15-Jul-07. So I never had any paystubs between 26-May-07 and 15-Jul-07. Now i want to go for a H1B stamping in canada.
I have got all other H1B Visa stamping related documnets except the paystubs between (13-Jan-07 and 04-Mar-07 )
and (26-May-07 and 15-Jul-07)
My questions are.
1) Can I go for H1-B Stamping?
2) Is it compulsory to have paystubs?

My lawyer says i can join company B as soon as USCIS has received my application for H1B transfer? is this true or do we have to wait for receipt number/case number?
I need to know this because my company will not file I-485 until i join them but under the current backlog CSC is having a huge backlog with receipting H1B transfer cases.

to port ur PD u shoudl have ur 140 approved from the first filing!
You can port PD only by sending in the previous approved 140 with the new 140 and request for interfiling!

First time I applied Labor Certification (LC) in 2004(pending, not approved or denied) and second time I applied on PERM without porting the first Labor application date with same company, same catagory(EB3) and same job description which approved with PD Feb 2006. I applied 485 on july last year when all PD were current.
Question: Can I port my PD from the first Labor application date now.

I know govt said anything regarding labor certifications etc are now only to be paid by employer...
what about fees related to extensions of h1 b? can i still pay for it or it's employer who has to pay...cause knowing my employer i know they won't want to pay and i wonder what options i have.

Hi,
I had a question about the H-1B cap. I am currently in F-1 status in
graduate school and am planning to finish my degree requirements
sometime in March/April 2007 and eventually need to be in H-1B status
to continue to work in the US.
I previously was in the H-1B status from Jan. 2001 till Sep. 2001 (9 months)
for which I was counted towards the FY2001 H-1B cap (more than 6 years ago).
In Sep. 2001, I switched to F-1 status to get a PhD and haven't been
outside the US for more than 4 weeks since then. My question is
will I be subject to the H-1B cap again, and get a new 6-year H-1B
term, if a for-profit employer files an H-1B petition for me for FY2008
?
OR
will I get the remaining 5 years and 3 months from my previous H-1B and
not be counted against the H-1B cap ?

You need to bring more clarity in your questions. Has your GC been approved and you are waiting for it to arrive in mail? or it is still pending approval. You do not need any visa to leave US. You will need it to get back in.

Yes, you can transfer to any employer and any number of times. At one point, I had 3 approved H1b, but as rule says, I could work only for one at a time :)
All the H1B's are valid till employer revokes it or it expires on its own.
The only danger I see in your case is continuous H1 status. If your current employerB goes ahead and cancels H1 petition, you would have worked illegally for the period of time you were with employerB. That can cause problem in your employerC h1 filling and/or future I-485 filling.
Even if employeeB cancels your petition but employerA hasn't cancel your h1 and it has not expired, then you will not be considered out of status, but you will be considered the one who have worked 'illegally'. This situation might give you h1 approval with employerC, but will have implications in 485 application.
Its better to wait till you get approval notice for employerB and then switch to employerC based on employerB's approval notice.

I went to Infopass to enquire about my interfile status. The first level officer said since my PD is not current, she will not allow me to meet the IO. I argued that PD has nothing to do with knowing the status and allow me to meet the actual IO. she still did not. What a crap !!!

I am currently working for a leading retail company in the US. I filed for my 485 in July 2007 and is pending. The retail company acquired my smaller company and as result had to file for 140 again in 2008. In March 2009 my I-140 was approved and I recd. an email that it was approved and the notice was sent.
Since the I-140 is mailed to the employer, I asked them for a copy of the same. Initially they refused saying it is an employer petetion and after I requested again they said they will provide a copy when the receive it.
It is June now and they claim they have still not recd. it. They are saying they will have to request another one and due to budget constraints they are not going to request one as it costs money. Is this true that you have to spend money again to request a copy if you never recd. it? How much does this cost? Without the copy i do not know what priority date is mentioned.
Suppose in future i want to switch jobs, I would like to know if I need to have a copy of 140 if I want to use AC21?
What are my choices as at this point company says that they have the petetion # and they can use that for any purpose and will not request a copy. This seems a little odd to me.

The only document that I know that suit the name " Unemployment Wage Report" is IRS Form 940-Employer's Annual Federal Unemployment (FUTA) Tax
Return.
The probable reason of asking-to verify, that Company is sound, paying salary, wages, then taxes, including unemployment tax.
The company's Tax Return also shows how's company doing financially,economically, if it able to pay their employees salaries and what business this company stated as her primary.
Therefore, I think, that asking for these docs seams as reasonable, keeping in mind that consulates and embassies belong to different department than DHS and USCIS.

Your parents can visit you for short trips as often as they like (within reason). But if they stay for an extended period (ie. the full 6 months stamped on the I94), then there is an implicit time gap requirement. In other words if your parents stay with you for 6 months then go back to their country and return to the US after 1 month, most likely they will not get a 6 month stamp the second time. In this scenario they might have plan their trip back to the US after 9 month or so. On the other hand if your parent stay with you for 1 month in the US, then leave for an other country and come back in 15 days, they should not have a problem with re-entry.
