Nice one, are u afraid of the last step?.......dying happily :) ==>DEATH !!

    EB3 Guys,

Take it easy... This is just for humour, to have fun at these times.

No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India, own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. Retire by the time your kids become earners. Grow vegetables in back yard. Do gardening and have fun. Thats how life should be. Do not hope for green card. H A V E F U N.

Actually we were called for interview at the local uscis, : My RD was Aug-17-2007 and the ND is Oct-15-2007. The DAO - District Adjudication Offcier gave me a heart attack saying that we are not eligible for GC as the cut-off date was 17-Aug and we were out of the window. Then I politely explained her, and then she looked at the RD and said that we would be fine. Also I called USCIS last week, and told that I filed on Aug, one rep said that they go by ND, I called again and the other rep said that "by ND". Not sure, may be uscis itself is not sure.
Anyhow, is it advisable to take an infopass now (i.e) before september . Wouldn't it be better to visit uscis office in september, so that we could strongly say that "We are current, and could something be done about our case".
I'm afraid that, if we go to uscis now saying that "We will be current in Sep", the uscis people might ask us come back again in Sep. And remember, we cannot have two consecutive infopass within 45 day. So what do you suggest?

Take the info pass is the best way for your solution. Best of Luck dude.

I incorporated the points you made and the revisions are in fuchsia:

    The Ombudsman
    USCIS

    September 10. 2008

    Sir/Madam,

On behalf of the employment-based legal immigrant community in the United States of America, I am writing to highlight the ongoing egregious inefficiencies in the immigration services provided by the USCIS and the DOS. There have been numerous occasions when there have been erratic movements in the DOS published visa bulletin dates. This, as we understand it, is owing to USCIS under- or over-estimating the number of applicants available for adjustment of status. And in the rare instances when the date finally moves forward by a substantial window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that??? Why bother publishing the cut-off date if approvals are to be randomly allocated???

We understand we have to stand in line and wait our turn. Each applicant is assigned a priority date which chronologically determines his/her turn for approval. To further complicate matters, once the I-485 is filed, a crop of other dates are issued by the USCIS a receipt date, a notice date and a processing date. USCIS then takes the liberty to throw random rules at us Case adjudication is based on receipt date No, we process applications based on notice date, Actually, its the processing date that determines which applications are adjusted. !!!

Please take a moment to consider how these conflicting statements and arbitrary decisions wreak havoc on our morale and psyches? No one, NOT even the USCIS, has a clue as to what exactly is happening in their processing centers. The USCIS has never been able to clearly state the exact number of applications languishing, excuse us, we meant pending, in their service centers! We, employment-based immigrants, are tax-paying, law-abiding, educated individuals contributing to Americas knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:

    1) Extended wait times at each step of the immigration process.
    2) Lack of transparency on the part of USCIS (re: priority date, receipt date, notice date).
    3) Lack of USCIS customer service once applications are submitted to USCIS they disappear into a black hole. Barring a website where one can nominally check ones case status (but which in reality remains static for months, even years!) there is no concept of updating an applicant on where his case stands. And this is despite the applicant paying immigration fees that often run into thousands of dollars over the years. We are simply expected to wait in a complete void of information, for however long it may take, until approval.
    4) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).

Another inconsistency, surfacing in August 2008, begs redressal while I-485 applicants (albeit those from 2006 instead instead of earlier years) at the TSC were being approved in a steady stream, the NSC was almost completely inactive resulting in only a very few cases being approved prior to August 20th. After this date, the NSC appeared to completely hold off on all I-485 approvals while approvals continued at the TSC. Could somebody please account for this preferential treatment for I-485 applicants at the TSC versus those at the NSC? Furthermore, when complaint faxes were sent in to the NSC in protest, instead of issuing a formal statement to explain their approach, the NSC retaliated by issuing a bunch of RFEs. Is the USCIS trying to intimidate us so that we remain quiescent??

While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled we are bound to our sponsoring employer from the start to the end of an extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later. We want USCIS to be accountable to us, its paying customers.

We request you to lend us your ear and address these issues so that we are not subjected to them in the future. Kindly note that there remain roughly 15 days until the October 2008 visa bulletin goes into affect. Once October arrives, the dates for Indian EB2 candidates retrogress to 2003. We believe you have the power to help a few more of us who have been waiting, seemingly endlessly, to get out of this immigration limbo.

    Thanking you,

I really appreciate your initiative in drafting this letter. Please let us know, how each one of us could contribute . Whom should the faxes/emails/pamplets be sent.

Perhaps, we could ignore you. Perhaps we could ignore your ignorance. Perhaps I could abuse you like you did. Perhaps. But I wont. Because I feel sorry.Perhaps you've been a loser your whole life and need to blame someone for your hard knocks in life. But that isn't the point. Perhaps you've forgotten, that the original Native Americans are called 'Indians' for a reason, because a certain Chris Columbus lost his way(he was no Pilgrim believe me)...while trying to find the 'then' promised land!. . Perhaps you've forgotten that 6 out of every 10 companies started in the last 15 years was by an immigrant. Perhaps you've forgotten that the Governor of the most wealthy State in the Union is an immigrant..... I could, perhaps go on...but I wont. Because I have to thank you. Thank you for stirring us up. Thank you for motivating us to action. Stirring up those of us who have been in a deep slumber.....we'll prove that we do matter and that we DO HAVE WHAT IT TAKES.

    Thanks brother.:)

    Yes,, they did...
Our forefathers travelled to the promised land in ships that were full of rats, without food or water. Several of them died while trying to reach here.
Once here on the promised land, we had to fight our way to create a free society that you are dying to be part of. America is land of entrepreneurs.
And any one that don't have an entrepreneurial spirit is not welcomed here.

What do you have to bring to the table?

    Hi,
    this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.

I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.

I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.

So don't judge others just because you have been lucky enough to maintain your status...

Good luck to you all in your I-485s

VZLAN, Ah! I can't return to my country since I am Venezuelan, and I don't plan to raise my kids under communism.

I am no expert but here is what I think.

by concentrating energy on spilled over milk, why not work towards recapturing unused visa numbers? It has been done in past successfully. It is in huge numbers, guess around 300-400K or so.

while wasting energy on 2-3K or may be 5K lc sub cases will do no good for everyone. visa recapture will solve problems for most of the community.

take your pick. its no brainer!!!

LC Sub is long gone. Those who *legally* got pre-2001 may already have gc by now, and its not going to affect them anyway.

Think in a professional manner and do what provides the most benefit.

ok , agreed. Can pappu get it done within certain time. How much does it cost?
Lets share the bill. Straight to business!

    Leadership-

Most of the senior members and Admins either have left IV or not able to spend enough time together to plan and organize action plans for the community. This is what I feel we are missing. We are acting alone although we are part of community.

We need to come together and keep ourselves focussed on common issues related with congress bills, retrogression, IV Agendas and road-map for coming months or years.

I mostly see pappu from core IV leadership. Where are other folks. If current leaders cannot lead us in the future, we need to find someone who could.

Again, my intention is not question anyone's hard work, but I am not seeing the same momentum and focus we had year back.

My case has some similarities, except marrying an American and divorce, but I was out of status for a long time and I thought there was no hope at all. One of my former clients offered me a job and sponsored my h1 of course. I went home and have my new h1 stamped and came back. I was out of status probably for more than two years. Now, I just got my receipt for July 2 485 application. My PD is April 2006. I'm read people are talking here that when you re-enter on a new h1, your previous out of status "status" will be irrelevant.

My opinion is that you should be fine. Just make sure that you've nailed everything down correctly on your G-325A.

On my 485 receipt, I have RD as 7/20/07, ND as 9/13/07. But when I check my case online, it has 9/12/07.

I had called TSC yesterday and the rep kept telling 9/12/07 and TSC is processing 8/30/07. I told her I have the original receipt in front of me and it says 7/20/07 and not sure where you are getting 9/12 from. She said "Oh I am sorry, I was looking at the incorrect place". She later gave me a SR # and took all the info. The funny part was she even refused to open a SR telling the date was 9/12.

Not sure whether opening a SR now will help but trying does not hurt and it is FREE !!!! Hopefully the officer looks at my file and then approves it.

If you look at my previous posts on this thread, you will get clear picture of what happens. TSC did receive your application on 9/12/07, although USCIS received it on 7/20/07. They entered your data on 9/12/07, and sent out notice the next day. For the two months, it was perhaps lying somewhere with several thousand other applications no one wanted to accept. Mine was received on 7/2/2007, but entered in the system on 10/11/2007.

TSC doesn't care where your file was until they received (and agreed to accept it), which was on 9/12/07. So they say, they (TSC) received it on 9/12/07. Unless somebody has instructed centers to place physical files where they should have been based on the mailroom RD, it is very unlikely that they do anything but place in order they received them i.e. for your case, place your file behind those received (by TSC) on 7/11/07. It is not good, but that's what it is when they say "we process cases in order we receive them" (note that here "we" means the center, not USCIS)

It is unfortunate that it works this way, but there is no other explanation to what happens.

Just because this article says so doesnt mean its true. The whole point of this article was to demonize the law enforcement efforts directed against illegals.
    This is from amnestyusa website:

    Hello guys,
On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions.

She is of course not going to stay with the baby alone anymore
Hi I think you need to go to the cops for this reason

    1) You have evidence of child abuse(video of the nanny severally beating a child in state of new Jersey)

"Approximately 18 States and Puerto Rico require all citizens to report suspected abuse or neglect, regardless of profession."

Ref: Mandatory Reporters of Child Abuse and Neglect
    Child Welfare Information Gateway www.childwelfare.gov
    http://www.thefreedomresource.org/documents/mandatorychildabusereporting.pdf

    2) IMHO even immigrationvoice.org bears responsibility of duty to warn. You have evidence that child is still being kep under care of namny who may abuse

    http://en.wikipedia.org/wiki/Duty_to_warn
    http://en.wikipedia.org/wiki/Tarasoff_v._Regents_of_the_University_of_Californi a

Immigration and CHild abuse are different matter but they are both prosecuted by the same US attorneys. going after you for hiring an illegal alien" ie. prosecuting parents of child abuse may not be in their best interest either
